UK Export Control Regulation

What is it?

Exporters are responsible for complying with export laws and ensuring they have solid export control systems and procedures in place in terms of record keeping, training and lines of responsibility.

The UK's export control laws for 'strategic goods' (military or Dual-Use items) are defined in the UK's parliamentary statutory legislation which includes the Export Control Act 2002 and the associated order, the Export Control Order 2008. The legislation also includes the Control Lists, which underpin export control law by providing a list of controlled items, which include:

  • Items that have been specially designed or modified for military use and their components
  • Dual-use items - those that can be used for civil or military purposes - which meet certain specified technical standards and some of their components
  • Associated technology and software
  • Goods that might be used for torture
  • Radioactive sources

What's the risk?

Exporters who fail to comply with Export Control regulation risk:

  • Suspension or revocation of the exporter's Open Individual Export Licences
  • Suspension or revocation of the exporter's ability to use one or more Open General Export Licences
  • Fines and/or prosecution (including custodial sentences) for exporting without a license
